These Terms of Service govern your use of the OTAKI online store, website, and related online services. By accessing or using the OTAKI website or placing an online order, you agree to these Terms of Service.

These Terms apply to OTAKI's online presence, including the website, online shopping services, online orders, local pickup orders, pre-orders, special orders, customer accounts, reviews, and other online services provided by OTAKI.

1. Eligibility

OTAKI is not an age-restricted store. Customers of any age may use the website and place orders.

If you are under the age of majority in your jurisdiction, you should have the permission of a parent or legal guardian before making a purchase.

2. Products and Product Information

OTAKI sells hobby products, model kits, figures, collectibles, tools, paints, accessories, and other related products.

We make reasonable efforts to ensure that product descriptions, specifications, images, pricing, availability, and other information displayed on the website are accurate. However, errors may occasionally occur.

Model kits and other products may be shown using official manufacturer box art, product photography, or promotional images. Product packaging, box art, colours, accessories, specifications, or other details may change when manufacturers update their products. OTAKI may continue displaying the original product imagery or information until the website listing is updated.

OTAKI reserves the right to correct errors or omissions in product information at any time.

3. Pricing Errors

OTAKI makes reasonable efforts to maintain accurate pricing. However, if a product is listed at an incorrect price due to a typographical, technical, system, or other error, OTAKI reserves the right to correct the price and cancel an affected order.

If an order is affected by a pricing error, OTAKI will provide the customer with the option to:

  • Receive a full refund of the affected order; or

  • Purchase the item at its correct price.

If the customer chooses not to purchase the item at the corrected price, the affected order will be cancelled and refunded.

4. Inventory and Availability

Product availability displayed on the website is subject to change.

If an item is shown as available but OTAKI subsequently discovers that the item is unavailable, OTAKI may cancel the affected order or remove the unavailable item before the order is fulfilled.

If an order or portion of an order is cancelled because an item is unavailable, OTAKI will provide a full refund for the affected amount.

OTAKI may also cancel an order if an item becomes unavailable from a manufacturer, distributor, supplier, or other source.

OTAKI reserves the right to limit quantities purchased of any product, including products that are in high demand or limited supply.

5. Orders

Placing an order through the OTAKI website constitutes a request to purchase the selected products.

OTAKI reserves the right to accept, refuse, or cancel an order at its discretion, including where there are issues involving inventory, pricing, payment, suspected fraud, abuse of the website, technical errors, or other circumstances that make fulfilling the order unreasonable or impossible.

If OTAKI cancels an order after payment has been successfully processed, OTAKI will generally issue a full refund of the cancelled order, subject to applicable law.

An order is not considered fulfilled until OTAKI has processed and prepared the order for shipment or local pickup.

6. Order Changes and Cancellations

Online orders may be cancelled without charge within one hour of the order being placed.

After the one-hour cancellation period, customers may contact OTAKI if the order has not yet shipped. OTAKI may be able to change an item, swap an item, or otherwise modify the order, depending on the circumstances.

OTAKI does not guarantee that changes can be made after the one-hour cancellation period.

If OTAKI agrees to cancel an order after the one-hour period but before it has shipped, OTAKI will issue a full refund.

Once an order has shipped, changes and cancellations generally cannot be made.

Nothing in this section limits any cancellation rights provided to consumers under applicable law.

7. Payment

OTAKI accepts payment methods made available through Shopify and its supported payment providers.

Payment must be successfully authorized and processed before an order can be fulfilled.

OTAKI reserves the right to cancel an order if payment cannot be successfully completed or if a payment is reversed, disputed, charged back, or otherwise invalidated.

Any resulting refund will be handled in accordance with these Terms, the applicable refund policy, and applicable law.

8. Shipping

OTAKI ships orders using available shipping carriers and services selected or offered at checkout.

Shipping and delivery dates shown during checkout or provided after purchase are estimates unless expressly stated otherwise. Carrier delays, weather, transportation disruptions, customs delays, and other circumstances outside OTAKI's reasonable control may affect delivery times.

OTAKI is not responsible for delays caused by third-party shipping carriers or circumstances outside OTAKI's reasonable control.

Customers are responsible for providing an accurate and complete shipping address.

If you discover that your shipping address is incorrect, contact OTAKI before the order ships. OTAKI may be able to correct the address before shipment, but we cannot guarantee that changes will be possible.

Once an order has shipped, OTAKI generally cannot change the shipping address.

If an order is returned to OTAKI because the customer provided an incorrect address, failed to receive the package, or otherwise caused the delivery to fail, OTAKI is not responsible for automatically reshipping the order or issuing a refund. Any resolution will be handled according to the circumstances and applicable law.

9. Local Pickup

Customers may select local pickup where available.

Once an order is ready for pickup, OTAKI will hold the order for 15 business days.

Customers should bring their order confirmation when picking up an order.

If an order is not collected within the 15-business-day holding period, OTAKI may cancel the order. Amounts paid for the order will not be refunded where the cancellation is permitted under OTAKI's applicable policies and law.

Nothing in this section limits any consumer rights provided by applicable law.

10. Pre-Orders

Pre-orders are paid in full when the pre-order is placed.

Amounts paid toward a pre-order are non-refundable if the customer voluntarily cancels the pre-order, subject to any rights provided under applicable law.

Shipping is not charged at the time of the pre-order. Once the item arrives and is ready to be shipped, OTAKI will contact the customer and collect the applicable shipping charge.

If a customer cancels a pre-order, the customer will not be charged the later shipping amount.

Manufacturer release dates and estimated arrival dates are subject to change. OTAKI will provide updates when significant changes to expected shipping or release timing are known.

If a manufacturer cancels a product, discontinues production, or otherwise makes the product unavailable, OTAKI may cancel the affected pre-order and provide an appropriate resolution, including a refund where applicable.

11. Special Orders

Special orders are treated similarly to pre-orders.

OTAKI may require full payment before ordering a special-order product from a supplier or manufacturer.

Amounts paid toward special orders are non-refundable if the customer voluntarily cancels the order, subject to any rights provided under applicable law.

Special-order products may be subject to manufacturer availability, supplier availability, pricing changes, and delays.

12. Returns, Refunds, and Damaged Products

OTAKI's Returns & Refund Policy forms part of these Terms of Service.

OTAKI generally does not accept ordinary returns for change of mind, unwanted products, opened products, used products, or assembled model kits.

Exceptions may apply for incorrect items, qualifying damage, defective products, missing parts, or other circumstances described in the Returns & Refund Policy.

Customers should review the full Returns & Refund Policy before placing an order.

Nothing in OTAKI's return, refund, cancellation, or exchange policies limits rights provided to consumers under applicable law.

13. Website Use

You agree to use the OTAKI website only for lawful purposes.

You may not use the website to:

  • Attempt to gain unauthorized access to the website or its systems;

  • Interfere with the operation or security of the website;

  • Introduce malicious software, viruses, or other harmful code;

  • Use automated systems, bots, or scripts to abuse the website or interfere with normal operations;

  • Attempt fraudulent transactions or payment activity;

  • Abuse promotions, discounts, coupons, or other offers;

  • Scrape, copy, or collect information from the website in a manner that interferes with OTAKI's operations;

  • Impersonate another person or business; or

  • Engage in any activity that violates applicable law.

OTAKI reserves the right to restrict or terminate access to the website or online services where necessary to protect OTAKI, its customers, or the website.

14. Customer Accounts

Customers may create an account through Shopify where account functionality is available.

Customers are responsible for maintaining the confidentiality of their account credentials and for activity conducted through their account.

If you believe your account has been accessed without authorization, you should contact OTAKI and Shopify as soon as possible.

OTAKI may report suspected fraudulent or abusive account activity to Shopify and may take appropriate action through Shopify's platform.

15. Promotions and Discounts

Promotions, discounts, coupons, and special offers may be subject to additional terms and conditions.

OTAKI reserves the right to correct errors, limit quantities, restrict eligibility, or cancel promotional orders where a promotion has been misused, improperly applied, or affected by a technical or pricing error.

Promotions cannot be combined unless expressly stated otherwise.

16. Intellectual Property

The OTAKI name and OTAKI logo are the property of OTAKI and/or Ondaway Enterpraise Inc. and may not be copied, reproduced, modified, or used without permission.

Product names, trademarks, logos, character names, manufacturer names, product photography, official box art, and other intellectual property belonging to manufacturers, publishers, licensors, and other third parties remain the property of their respective owners.

Except for the OTAKI name and logo, OTAKI does not claim ownership over third-party intellectual property appearing on the website.

Much of the product information and imagery used by OTAKI is provided by manufacturers, distributors, or other official sources.

17. Customer Reviews and User Content

Customers may have the ability to submit product reviews, photographs, comments, ratings, or other content through the website.

By submitting content, you agree that you have the right to submit that content and that it does not violate applicable law or the rights of another person.

OTAKI reserves the right to remove or decline to publish content that is, in OTAKI's reasonable judgment:

  • Abusive or threatening;

  • Offensive or inappropriate;

  • Spam;

  • Fraudulent or misleading;

  • Illegal;

  • Promotional or advertising content;

  • Unrelated to the product or website; or

  • Otherwise unsuitable for the OTAKI website.

18. Third-Party Services

OTAKI's online store relies on third-party services, including Shopify, payment processors, shipping carriers, manufacturers, suppliers, and other service providers.

These third parties may have their own terms, conditions, policies, and privacy practices.

OTAKI is not responsible for outages, failures, delays, or other issues caused by third-party services that are outside OTAKI's reasonable control.

19. Events Outside OTAKI's Control

OTAKI will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters;

  • Severe weather;

  • Fires;

  • Power outages;

  • Internet or telecommunications failures;

  • Shopify or payment-platform outages;

  • Shipping carrier disruptions;

  • Manufacturer or supplier delays;

  • Government actions or restrictions;

  • Labour disruptions;

  • War or civil emergencies; or

  • Other events beyond OTAKI's reasonable control.

OTAKI will make reasonable efforts to communicate significant disruptions affecting customer orders.

20. Limitation of Liability

To the fullest extent permitted by applicable law, OTAKI's liability relating to an individual online order will generally be limited to the amount paid by the customer for that order.

OTAKI will not be responsible for indirect, incidental, special, consequential, or other losses arising from the use of the website or an order, except where such limitation is prohibited by applicable law.

Nothing in these Terms is intended to exclude or limit liability or consumer rights that cannot legally be excluded or limited.

21. Privacy

Information collected through the OTAKI website is handled in accordance with OTAKI's Privacy Policy.

Customers should review the Privacy Policy to understand how personal information is collected, used, disclosed, and protected.

22. Changes to These Terms

OTAKI may update or modify these Terms of Service from time to time.

The current version will be posted on the OTAKI website with the applicable update date.

Changes will generally apply to future use of the website and future orders placed after the updated Terms take effect. OTAKI will not use a later change to these Terms to retroactively alter the terms of an order that has already been completed or a contract where doing so would violate applicable law.

23. Governing Law

These Terms of Service are governed by the laws of the Province of British Columbia and the applicable laws of Canada.

Subject to any mandatory consumer protection rights or other applicable law, disputes relating to these Terms or OTAKI's online services will be subject to the applicable courts of British Columbia.

24. Consumer Protection Rights

Nothing in these Terms of Service is intended to remove, restrict, or waive any rights or remedies that customers may have under applicable Canadian or British Columbia law.

Where applicable law provides a customer with a cancellation right, refund right, warranty, remedy, or other protection that differs from these Terms, OTAKI will comply with those legal requirements.

For online purchases in British Columbia, certain statutory requirements apply to distance sales contracts, including required disclosures, contract information, delivery information, and cancellation rights in specified circumstances.
